Council wins Enforcement Notice appeal on Wyatts Lake Farm in Bromham

Wiltshire Council has successfully defended an appeal to its Enforcement Notice on the owner and occupiers of Wyatts Lake Farm in Bromham.

The notice, which was issued in February, required the importation and deposit of waste on the land to stop, that the land be cleared of all stored waste and other stored items, and that the land ceased to be used for residential caravan use.

The owner and occupiers of the land appealed this notice, but they lost the appeal on 1 October and the notice has been upheld in full. As a result, the freeholder and leaseholder of the land must now:

  • Stop the use of the land for the importation and deposit of waste within one month from 1 October 2025.
  • Stop the use of the land for the open storage of waste within 18 months from 1 October 2025.
  • Stop the use of the land for general storage within 12 months from 1 October 2025.
  • Stop the use of the land for the stationing of caravans for residential occupation within six months from 1 October 2025.

Should any of these requirements not be met, the council will consider a High Court Injunction and/or criminal prosecution for non-compliance of the notice.

Cllr Adrian Foster, Cabinet Member for Strategic Planning, Development Management, and Housing, said: “It is good news that this appeal was rejected and the owners and occupiers of Wyatts Lake Farm must now abide by the Enforcement Notice.

“Throughout this process, our Planning Officers have made every effort to work constructively with the owner and occupiers, but they have continued to breach planning regulations by storing waste and hosting unauthorised residential caravans on the site.

“We will now be monitoring the compliance of this Enforcement Notice and will take appropriate action if the requirements are not met.”
